The Labor Department's ERISA Advisory Council is expected to issue a report in November on health care issues that should be addressed through amendments to ERISA.
Peter Turza, chairman of the council's health care work group, said it's not clear which retiree health issues will be addressed, but he said members were concerned about enforcing promised benefits to retirees and adequately funding retiree health benefits.
Mr. Turza, an attorney at Gibson, Dunn & Crutcher, Washington, added the report might address tax treatment on retiree health contributions. A recommendation may be made to enhance tax advantages to fund retiree benefits, he said.
