The Second Circuit U.S. Court of Appeals unanimously denied The New York Times and other publishers a rehearing of an electronic copyright decision in a case brought by the National Writers Union.
The defendants including Newsday, Time magazine, Mead Data Central and University Microfilms International petitioned for a full review of the three-judge panels ruling last fall that it is copyright infringement for a publisher to post a free-lancers work online or reuse or resell it without explicit written permission.
New York City Comptroller Alan Hevesi, who oversees $100 billion in pension funds, recently expressed concern to 36 media companies in its portfolios about the potential liability of media companies because of the ruling.
