Sara Tirschwell, a former managing director of TCW's distressed debt strategy group, is appealing portions of a New York trial ruling that dismissed part of her gender discrimination lawsuit against TCW Group, according to the notice of appeal filed Thursday.
New York State Supreme Court Justice Robert D. Kalish, in an opinion dated June 11, dismissed three of five causes of action against TCW and David Lippman, TCW president and CEO, including that they retaliated against her when she complained about sexual harassment by her boss and co-defendant Jess Ravich and gender discrimination. The court also dismissed a claim that Mr. Lippman aided and abetted and her cause of action for retaliation against Mr. Ravich.
Mr. Kalish also threw out her request for punitive damages against all the parties.
Ms. Tirschwell's attorney, Steven G. Storch, managing partner of Storch Byrne, said in a written statement: "All of Ms. Tirschwell's claims, not just those remaining, should be put before the jury, and the jury should decide what damages, including punitive damages, are warranted after hearing the witnesses and reviewing the evidence supporting her claims of sexual harassment she endured at TCW. We look forward to that trial."
Doug Morris, TCW spokesman, declined to comment.
