Caribbean International News Corp., San Juan, Puerto Rico, was ordered to restore $1.2 million to the El Vocero de Puerto Rico Union Employees Savings and Investment Plan, a $4.5 million defined contribution plan, said John Chavez, a Department of Labor spokesman.
Chief Judge Jose Fuste of U.S. District Court in San Juan ruled in favor of the Labor Department, which had claimed that Caribbean International violated ERISA by failing to deposit $1.2 million in employer matches and employee contributions into the newspaper’s plan from 2003 to 2006, Mr. Chavez said.
Miguel Roca, El Vocero president, had not returned calls for comment by press time.
