CMDL Corp., Sarasota, Fla., received permission this week from a federal bankruptcy court judge to file an application to have the PBGC to take over the company's $20 million pension plan, according to federal court filings. The former Comdial Corp. filed for Chapter 11 bankruptcy protection last year and was acquired by Vertical Communications Inc., Cambridge, Mass., in September. The Comdial plan was underfunded by $9.7 million at the end of 2004, according to the court documents.
Jeffrey Speicher, spokesman for the PBGC, said that the agency has not yet received Comdial's application for termination.
