Global Crossing Ltd. employees last week sued the officers, directors and administrator of the bankrupt companys 401(k) plan in U.S. District Court in Los Angeles for breach of fiduciary duty under ERISA. BARRA RogersCasey is administrator, according to the complaint.
Plaintiffs may amend the complaint to add racketeering charges, said Paul D. Murphy, partner with the law firm ONeill Lysaght & Sun. ONeill Lysaght is co-lead counsel for plaintiffs with Keller Rohrback. Once the defendants have been served with the complaint, they have 20 days to respond. The defendants could not be reached for comment.
