Unisys Corp. workers who lost a lawsuit against the company have now asked the 3rd U.S. Circuit Court of Appeals for a rehearing before the entire bench. Their contention is the company violated its fiduciary responsibilities under ERISA when it purchased $217 million of Executive Life Insurance GICs for its 401(k) retirement plan. The participants filed the petition for a rehearing after the appellate court upheld a lower courts decision that Unisys had not breached its fiduciary duties. The Unisys participants filed the petition for a rehearing April 2, said James R. Malone, partner in the law firm of Chimicles, Jacobsen & Tikellis, a lawyer representing the plaintiffs.
